Terms of Service

1. Agreement to Terms
These Terms of Service ("Terms") govern your access to and use of PitchGov, a service operated by Literally Anything LLC("Company," "we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms.
If you do not agree to these Terms, do not use the Service.
2. Description of Service
PitchGov is a subscription-based web application that aggregates open government RFP (Request for Proposal) opportunities from federal, state, and local sources and makes them searchable and trackable for marketing and advertising agencies. We do not create, verify, or guarantee the accuracy of any RFP listing. All RFP data is sourced from public government procurement portals.
3. Subscription Terms
a. Pricing
PitchGov is offered on the following subscription plans:
- Monthly Plan: $9.99 per month, billed monthly
- Annual Plan: $99.00 per year, billed annually (equivalent to $8.25/month)
Prices are in U.S. dollars and are subject to change with 30 days' notice to existing subscribers.
b. Free Trial
New subscribers on the Monthly Plan are eligible for a 7-day free trial. No charge will be made during the trial period. At the end of the trial, your subscription will automatically convert to a paid monthly subscription unless you cancel before the trial ends. The Annual Plan does not include a free trial and is billed immediately upon signup.
c. Automatic Renewal
Subscriptions automatically renew at the end of each billing period (monthly or annually) unless cancelled. By subscribing, you authorize Literally Anything LLC to charge your payment method on a recurring basis.
d. Cancellation
You may cancel your subscription at any time from the Account page within the application. Cancellation takes effect at the end of your current billing period. You will retain access to the Service until your paid period expires. We do not prorate partial billing periods.
4. Refund Policy
All sales are final. We do not offer refunds for any subscription fees, including partial months, unused time after cancellation, or annual plans. If you cancel during a free trial before being charged, you will not be billed. If you have a billing issue you believe was made in error, please contact us at outbreakcdc@gmail.com within 7 days of the charge and we will review it on a case-by-case basis.
5. Account Registration
You must provide a valid email address and create a password to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.
You must be at least 18 years old to create an account. By registering, you represent that you are 18 or older.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws or regulations
- Scrape, crawl, or systematically extract data from the Service using automated means
- Attempt to gain unauthorized access to any part of the Service or its infrastructure
- Resell, sublicense, or redistribute access to the Service to third parties without our written consent
- Reverse engineer, decompile, or disassemble any part of the Service
- Use the Service to transmit spam, malware, or other harmful content
- Impersonate any person or entity or misrepresent your affiliation with any person or entity
- Interfere with or disrupt the integrity or performance of the Service
We reserve the right to suspend or terminate accounts that violate these terms without notice or refund.
7. Intellectual Property
The PitchGov platform, including its design, code, features, and branding, is owned by Literally Anything LLC and protected by applicable intellectual property laws. RFP data displayed through the Service is sourced from public government portals and remains the property of the respective government agencies.
You retain ownership of any notes, bid status updates, or other content you create within the Service.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that: (a) the Service will be uninterrupted, error-free, or secure; (b) RFP data will be complete, accurate, or up to date; (c) any particular RFP opportunity will result in a successful bid or award; or (d) the Service will meet your specific business requirements.
Government RFP data is aggregated from public sources and may be delayed, incomplete, or inaccurate. You are solely responsible for independently verifying any opportunity before acting on it.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LITERALLY ANYTHING LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) $100.
10. Indemnification
You agree to indemnify, defend, and hold harmless Literally Anything LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
11. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms with a new effective date. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
13. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in California.
Before initiating any formal legal proceeding, you agree to first contact us at outbreakcdc@gmail.com to attempt to resolve the dispute informally.
14. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Literally Anything LLC regarding your use of the Service and supersede all prior agreements and understandings.
